CROWN POINT — A Gary man supposedly lay in wait and ambushed the man whom he believed killed his brother to avenge his brother's death, a prosecutor said Tuesday morning at the opening of the man's murder trial.
Deputy Prosecutor Michelle Jatkiewicz said Martell Flippins, 36, parked his green Chevrolet Equinox on the opposite side on the street from the now-shuttered Fatso's Pub, 5060 Broadway, as he waited for Pierre Patterson, 24, to leave the bar on March 12, 2023, slightly one year after Flippins' brother, 26-year-old LaVell Hughes Jr., was shot and killed.
"A cold, snowy night," Jatkiewicz tells the jury, "and Martell Flippins waits and he watches."

Patterson was a suspect in Hughes' murder, Jatkiewicz said. In fact, the State of Indiana had been prepared to charge him with the crime. However, instead of waiting for the criminal justice system to prosecute the case, Flippins took matters into his own hands, she said, and fired six shots at Patterson. He was pronounced dead and his death was ruled a homicide, according to the Lake County coroner's office.
Jatkiewicz said technology was key to helping detectives secure charges in the crime and the jury will have the chance to hear from the investigators themselves about the use of surveillance footage, license plate readers and location data from Flippins' cell phone she said will demonstrate his culpability in the crime.
During public defender Marc Laterzo's opening statement, he said much of what Jatkiewicz said is not in dispute. However, there is no proof that it was Flippins who was driving the Equinox that night nor that he was the one who fired the gun.
"Hughes had other brothers, other cousins, all who had the same motive the state is trying to attribute to Mr. Flippins," Laterzo said.
Laterzo alleged they all had access to the Equinox and could have driven that vehicle the night of the homicide. Detectives executed a search warrant at the home of Flippins' mother where she lived with his siblings, but not Flippins himself. He said there is no evidence there connected to Flippins.
Gary police Officer Eric Green testified that he was the officer who analyzed footage taken from multiple security cameras around Gary around the time of Patterson's death. The jury watched the footage as Green pointed to an image of a car he said he believed to be the Equinox drive north on Broadway around 12:45 a.m., make a U-turn and park on the east side of the street. The car's headlights then switch off.
Green identified a man believed to be Patterson who leaves the bar around 3 a.m., strolls down the street and crosses east, he said. A car immediately pulls forward and multiple muzzle flashes can be seen as the man falls to the ground the vehicle speeds off.
The camera footage showed multiple angles of the street. However, the footage was pulled from different businesses, so some of the footage is in color and some in black and white. Flippins' other public defender Sonya Scott-Dix said it's not clear in the footage what color the vehicle is in the black and white video clip, nor is the license plate visible.
Patterson's loved ones gathered in the courtroom to watch the trial. They said they remember him for his infectious energy and as a doting father to his nine children, ages one through eight.
"He was a family man," his brother Deangelo Rock said. "He was very caring, kind and understanding."
His sister Denishia Marshall described him as the "life of the party."
The trial is expected to go until Thursday in Lake Criminal Court Judge Salvador Vasquez's courtroom.
